Intellectual Property Litigation & Dispute Resolution

We successfully represented a technovator in a groundbreaking case under Part XIV of the Industrial Property Act, securing both technovation recognition and remuneration rights for his innovation—a GIS (Geographic Information System) platform. The ruling affirmed the importance of protecting local innovations in high-tech industries.

In trademark litigation, we acted for an applicant in an expungement proceeding where a competitor had attempted to register a similar mark in the same industry. We successfully demonstrated the likelihood of confusion, and the conflicting trademark was removed from the register.

In a copyright infringement matter, we defended a fintech company whose website content had been plagiarized. Following our legal intervention, the infringing material was promptly taken down.

We also acted for a popular musician in a copyright claim where her song had been used in a movie production without consent. Our team asserted her rights and initiated a successful claim for infringement.

Regulatory & Legislative Advisory

We were engaged by the World Intellectual Property Organization (WIPO) to draft both the Copyright Regulations and Collective Management Organisation (CMO) Regulations for the Kingdom of Eswatini under its Copyright Act—ensuring modern, rights-based frameworks for copyright enforcement.

We also conducted a comprehensive policy study for the Kenya Association of Manufacturers on harmonizing intellectual property rights across the East African Community. The study contributed to regional IP integration and resulted in successful outcomes in arbitration, including general damages and intellectual property awards.

Commercialization & Innovation Support

We advised a GIS software developer in a joint venture and equity investment transaction, handling negotiations and drafting agreements for both technology transfer and corporate structuring.

In another project, we oversaw the registration of utility models for inventions such as shopping carts and remote weighing systems, helping innovators secure legal protections in Kenya.

Trademark & Copyright Portfolio Management

Our IP practice also includes end-to-end trademark registration and management. We registered over 10 trademarks for a coaching company, 7 for a publishing house, and several others for real estate, consultancy, and legal services clients.

We routinely handle assignments and renewals for entertainment clients, ensuring the continuity and protection of their brand assets. Our services also extend to copyright advisory, particularly in music and film rights, to safeguard creators from unauthorized use.

Capacity Building

As part of our thought leadership, we regularly conduct IP training, workshops, and talks for professionals, startups, and institutions, helping build a culture of awareness around innovation and legal protection.
