Science and Emerging Laws

Explore how we’ve supported clients across sectors like data protection, ICT, science, sports, and agriculture—delivering practical legal solutions tailored to dynamic regulatory landscapes.

Data Protection

We served as the lead consultant for a donor-funded health institution on a comprehensive data protection compliance program. This engagement involved auditing existing data governance frameworks, identifying compliance gaps, and supporting the implementation of robust data protection practices. We drafted key documents including the data protection policy, consent forms, complaints policy, and data retention policy.

Our team helped the organization establish a functional data governance structure, which included forming a multi-disciplinary internal committee and appointing a data protection officer. The project concluded successfully with the client obtaining certification as both a data controller and data processor from the Office of the Data Protection Commissioner.

We’ve also advised a range of other entities on data privacy compliance:

  • A human resource recruitment firm, where we provided guidance on data consent forms for job applicants.

  • An ICT data firm, where we developed and implemented tailored data protection policies.

  • A marketing company, specifically advising on lawful practices for cold-calling and consumer data handling.

ICT & Emerging Laws

We’ve advised on cutting-edge legal issues in technology deployment and software development. As lead consultants for a software developer engaged by the Judiciary of Kenya, we advised on the legal aspects of transcribing software for court proceedings, including data protection and licensing agreements.

In the healthcare tech space, we advised a local project manager implementing Indian-supplied hospital software in Kenya. Our support included tri-partite contract structuring and cross-border implementation strategies.

We also acted for an equity investor in a joint venture financial technology firm developing a web-based e-commerce payment system. We facilitated the incorporation, drafted corporate governance documents, and handled technology transfer agreements.

In the geospatial sector, we represented a GIS system innovator seeking equity investment, leading negotiations and structuring the legal framework of the project. We also represented a technovator in a dispute against their employer over intellectual property rights, asserting ownership over key innovations.

Sciences

We act at the intersection of law, medicine, and research. Our team represented a claimant in a medical negligence case involving a misdiagnosed mental illness, holding the psychiatric clinic professionally accountable.

We have also conducted a legal audit and compliance review for a psychiatric clinic and advised a global research entity on human rights in Kenyan scientific research—focusing on constitutional protections under the Bill of Rights.

Additional work includes:

  • Representing a global institution in a social media defamation case filed by a blogger.

  • Incorporating the Kenyan subsidiary of a climate science and research institution and securing a research permit.

  • Advising a major hospital on staff redundancy processes.

  • Consulting on the Health Act, including e-health regulations and the legal implications of AI-enabled health data management.

Sports & Entertainment

Our firm protects the rights of creatives, athletes, and organizations in the entertainment and sports space.

We have:

  • Acted for a leading singer in a copyright and image rights dispute involving unauthorized use of her music on a TV show.

  • Represented rugby event attendees in enforcing their image rights against a sponsor's unauthorized promotional use.

  • Advised a donor-funded publisher on trademark registrations under Class 41 of the Nice Classification system.

  • Provided end-to-end legal support for a magazine—including copyright advisory, contributor contracts, trademarking, and compliance with the Books and Newspapers Act.

We also represented an events company in securing trademarks, licenses, and supplier contracts, as well as data protection and image rights compliance. Our team continues to advise several golf and sports clubs on routine legal matters.

Agriculture & Food

Our firm has a strong track record in the tea and agricultural sectors. We led a taskforce organized by the Tea Board of Kenya and the Specialty and Purple Tea Association to advise on corporate governance in family-run farms.

Other engagements include:

  • Advising a leading purple tea company in the Mt. Kenya region on corporate restructuring and governance.

  • Acting in the sale of a tea factory in Kericho to a private investor.

  • Ongoing legal support to several privately owned tea factories, particularly in corporate governance and compliance matters.
